1. Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of Atlas, the QBD client portal app for iOS and iPadOS (also referred to as the "QBD App"; the two names refer to the same app). Atlas is provided by Quick by Design Ltd ("QBD", "we", "us", "our"), a company registered in England and Wales (company number 5914521, VAT registration 991 9014 94), registered office, The Mill House, Court Farm, Church Lane, Norton, Worcester, WR5 2PS.

By downloading, signing in to, or otherwise using Atlas, you agree to these Terms. If you don't agree to them, please don't use Atlas. If you're using Atlas on behalf of a company (for example, as an employee or contractor of a QBD client), you confirm you have the authority to accept these Terms on that company's behalf, and "you" in these Terms refers to both you personally and, where relevant, that company.

How Atlas handles your personal data is set out separately in the Atlas Privacy Policy. Where QBD processes data on behalf of a client company as a data processor, that processing is additionally governed by our Data Processing Agreement with that company; these Terms don't change or override that agreement.

2. Who can use Atlas

Atlas is business software. Full account access is provided to:

  • individuals at QBD client companies, invited by their company's Owner or by QBD;
  • QBD Growth Specialists, Creatives, Sales Agents, and administrators; and
  • prospective clients completing an onboarding submission (QBD Create or QBD Pulse).

Unauthenticated guests can browse Atlas's public content (blog, podcast, events, resources) and use enquiry forms without an account. Some features are gated further by your company role (Owner, Finance, or Sales) or by which QBD services your company subscribes to, as explained in the app.

You must be at least 18 years old to create an account. Atlas is not directed at children, and accounts are provisioned for working professionals, not personal or consumer use.

3. Your account

  • Atlas uses passwordless sign-in: a one-time passcode is emailed to you, and a session token then keeps you signed in on that device for up to 30 days. You're responsible for keeping your work email account and device secure, since anyone with access to either could gain access to your Atlas account.
  • Keep your profile details accurate. If your role, company, or company role changes, tell your company's Owner or QBD's Growth Specialist team so your access can be updated.
  • Company Owners are responsible for managing who at their company has access to Atlas, including inviting new users and revoking access for people who leave, using the My Company section of the app.
  • You can delete your account and its associated data at any time from within Atlas at Settings > Account > Delete Account, or by contacting us (see section 15). Deleting your account doesn't end QBD's separate services agreement with your company, if one exists.
  • We may suspend or revoke your access if we reasonably believe your account has been compromised, or if your session token is revoked, for example because your employment or engagement with a client company has ended.

4. Acceptable use

When using Atlas, you agree not to:

  • share your sign-in access, OTP codes, or session token with anyone else, or attempt to access an account that isn't yours;
  • use Atlas to access, view, or attempt to access data belonging to a company you're not authorised to act for;
  • reverse engineer, decompile, or attempt to extract the source code of Atlas, except to the limited extent applicable law gives you the right to do so despite this restriction;
  • scrape, harvest, or bulk-export data from Atlas other than through the features we provide for that purpose;
  • use Atlas to send unlawful, defamatory, abusive, or infringing content, whether through support tickets, content briefs, feedback, or elsewhere;
  • interfere with or disrupt Atlas, its servers, or the systems it connects to; or
  • use Atlas in any way that breaches applicable law, including UK and, where applicable, EU data protection law.

We may suspend or terminate your access if you breach this section; section 13 explains how termination works.

5. Content you submit

Some Atlas features let you submit your own content: support tickets and comments, project feedback and approvals, content briefs and ideas, private contact notes (Pulse Score), and photos taken with the business card scanner.

You retain ownership of anything you submit. By submitting it, you give QBD a licence to use, store, and act on that content for the purpose of providing Atlas and the underlying QBD services connected to it, for example acting on a support ticket or passing a content brief to your Growth Specialist. Content stored only on your device or in your own iCloud account (contact notes, bookmarks, tags) isn't accessible to QBD at all, as explained in the Privacy Policy.

You're responsible for making sure anything you submit doesn't infringe someone else's rights (for example, a business card photo of a third party should only be captured with an appropriate basis for doing so) and doesn't contain anything unlawful.

6. Data and content shown in Atlas

Much of what Atlas displays, your website analytics, search performance, email and social campaign data, Pulse Score, financial records, and Insights reports, is sourced from third-party or connected platforms, or written by your Growth Specialist. We take reasonable care in how this data is fetched and displayed, but:

  • we don't guarantee that third-party data is accurate, complete, or up to date, since it originates outside Atlas and can be delayed or revised by the source platform;
  • figures shown in Atlas are for information only. Financial data shown in the Billing section is a convenience view of your accounting records; our accounting system, not Atlas, is the authoritative record for invoicing and payment purposes, and Atlas doesn't process payments;
  • Pulse Score and any similar engagement scoring are indicative measures, not a guarantee of business outcomes; and
  • Insights reports reflect the professional judgement of your Growth Specialist at the time of writing.

If you rely on data shown in Atlas for a business decision, we'd encourage you to sight-check anything commercially significant against the source platform.

7. Availability and changes to Atlas

We aim to keep Atlas available and working well, but we don't guarantee uninterrupted or error-free access. Atlas depends on third-party infrastructure, including Apple's, that is outside our control, and on your own device and internet connection.

We may add, change, or remove features, and may need to take Atlas offline temporarily for maintenance. Where a change materially affects what Atlas does, we'll aim to give reasonable notice through the app or the About QBD channels you'd normally hear from us through.

8. Intellectual property

Atlas, including its design, branding, source code, and the QBD and Atlas names and logos, is owned by QBD or our licensors and is protected by copyright, trade mark, and other intellectual property laws. These Terms give you a personal, non-exclusive, non-transferable licence to use Atlas on your own Apple-branded devices for its intended business purpose; they don't transfer any ownership rights to you.

Any feedback or suggestions you give us about Atlas may be used by QBD to improve the app without any obligation to you, unless we agree otherwise in writing.

9. Relationship to your company's services agreement

If your company has a separate services agreement with QBD (for example, covering QBD Create, QBD Pulse, or other marketing services), Atlas is provided as a way of accessing and interacting with those services. These Terms govern your use of the app itself; they don't replace or override the commercial terms of that separate services agreement, including its own terms on fees, service levels, liability, or termination, which continue to apply to the underlying services. Where these Terms and that agreement conflict specifically on the operation of the app, these Terms apply; where they conflict on the underlying marketing services, that agreement applies.

10. Suspension and termination

You can stop using Atlas and delete your account at any time (section 3). We may suspend or terminate your access to Atlas, in whole or in part, if:

  • you breach these Terms, including the acceptable use rules in section 4;
  • your company's services agreement with QBD ends, or your role at that company ends;
  • we reasonably believe your account poses a security risk to Atlas or to other users; or
  • we're required to by law.

Where reasonably possible, we'll give you notice before suspending or terminating your access. What happens to your data after termination is set out in the Retention section of the Atlas Privacy Policy.

11. Disclaimers

Atlas is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, terms, and conditions not expressly stated in these Terms, whether implied by law or otherwise, including any implied warranty of satisfactory quality, fitness for a particular purpose, or non-infringement. Nothing in this section excludes or limits any warranty, right, or remedy you have as a consumer that can't lawfully be excluded (this section is primarily aimed at Atlas's use as business software by our clients' staff).

12. Limitation of liability

Nothing in these Terms excludes or limits QBD's liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that can't lawfully be excluded or limited.

Subject to the paragraph above, QBD isn't liable to you for any indirect or consequential loss, or for loss of profits, revenue, business opportunity, or data, arising from your use of Atlas. Our total liability to you arising out of or in connection with your use of Atlas in any 12-month period is limited to the amount your company paid QBD for one month's QBD Pulse service in that period.

This limitation applies whether the liability arises in contract, tort (including negligence), breach of statutory duty, or otherwise, and even if we were advised of the possibility of the loss.

13. Governing law and jurisdiction

These Terms, and any dispute arising from them or from your use of Atlas, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any such dispute, except that if you're a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.

14. Apple App Store terms

If you downloaded Atlas from the Apple App Store, the following additional terms apply, as required by Apple:

  • These Terms are agreed between you and QBD only, not with Apple, and QBD, not Apple, is solely responsible for Atlas and its content.
  • Apple has no obligation to provide maintenance or support services for Atlas.
  • In the event of any failure of Atlas to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Atlas to you, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Atlas, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are QBD's responsibility, as set out in these Terms.
  • QBD, not Apple, is responsible for addressing any claims by you or a third party relating to Atlas or your possession and/or use of it, including product liability claims, any claim that Atlas fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party claim that Atlas, or your possession and use of it, infringes that third party's intellectual property rights, QBD, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
  • You represent and warrant that you're not located in a country subject to a US Government embargo or designated a "terrorist supporting" country, and that you're not listed on any US Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when using Atlas (for example, your mobile network terms shouldn't be breached by your use of the app).
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.

16. Changes to these terms

We may update these Terms from time to time, for example when we add a new feature to Atlas or our legal obligations change. If we make a material change, we'll update the "Last updated" date at the top of these Terms and, where appropriate, notify you in Atlas. Continuing to use Atlas after a change takes effect means you accept the updated Terms.
